Recently, in response to incidents involving the concealment/omission/misrepresentation of cargo, Wan Hai Shipping reiterated its relevant notifications, emphasizing that it will pursue full and unlimited compensation from the responsible party in accordance with relevant international conventions and the terms of the transport contract, and stress that if a crime is constituted, it will be handed over to the judicial authorities for the pursuit of criminal liability without hesitation, and will not be lenient or tolerate any such actions
The specific content of the notification is as follows:
To ensure the safety of vessels, cargo, and other third parties, and to provide a safe maritime transport environment and to protect the interests of the majority of customers, Wan Hai Shipping once again emphasizes that all customers must truthfully and correctly declare their cargo. Any acts of false declaration cargo, such as concealment/omission/misrepresentation, etc., the carrier has the right to charge a penalty to the cargo party in accordance with the agreement made when parties enter into the transport contract, as follows.
(a) For dangerous goods boxes, it is necessary to provide authentic CLASS, UNNO, detailed product names, dangerous goods declarations and packaging certificates. In case of concealment, omission, or discrepancies between the actual goods and the declaration, once discovered, Party A must pay a penalty USD 100,000/UNIT. Payment must be made within 7 days after notification by Party B.
(b) If the concealed,, or misrepresented goods belong to non-dangerous goods, Party A shall pay a penalty of USD 100,000/UNIT and bear all risks liabilities, and compensation for losses arising therefrom. Payment must be made within 7 days after notification by Party B.
(c) If there are goods that have been, omitted, or misrepresented, and Party B notifies Party A, Party A must immediately pay USD 100,000/UNIT as a deposit. relevant deposit shall be used to cover subsequent costs such as container damage, demurrage charges (overtime charges for demurrage involving concealment are calculated at three times), charges, relevant handling charges of customs at various locations, etc., and to bear all risks, liabilities, and compensation for losses in the event of any safety accidents. If there any shortage in the amount, it shall be supplemented. Payment must be made within 7 days after notification by Party B.
In addition to the above penalties and deposits the shipping company also reserves the right to claim compensation from the responsible party and pursue its legal liability.
