Recently, Wan Hai Lines has once again reiterated the penalty measures regarding cargo concealment/om/misrepresentation incidents, emphasizing the need for truthful and accurate cargo declaration.
Wan Hai Lines stated that in response to the recent frequent incidents of cargo concealment omission, and misrepresentation, the shipping company will strictly adhere to the relevant international conventions and specific clauses in the transportation contract, and will carry out full and unlimited compensation actions against responsible party. Once such actions are determined to constitute a crime, the involved party will be handed over to the judicial department, and their criminal responsibility will be pursued according to the law making it clear that there will be no tolerance or indulgence.
The safety and stability of the maritime transport environment are related to the safe navigation of ships, the integrity cargo, and the legitimate rights and interests of other third parties, and are also closely connected to the vital interests of the majority of customers. To fully create a safe and reliable maritime environment and effectively protect the interests of every customer, Wan Hai Lines emphasizes: all customers have the obligation to truthfully and accurately declare cargo information. If any form of cargoment, omission, or misrepresentation occurs, as the carrier, it will charge the corresponding penalty to the shipper according to the terms clearly agreed upon by both parties when the contract is signed, as specified below:
(a) For dangerous goods boxes, it is necessary to provide authentic CLASS, UNNO, detailed product names, and dangerous declaration forms and packaging certificates. If there is concealment, omission, or inconsistency between the actual goods and the declaration, once discovered, Party A must pay a penalty of 100,000/UNIT. Payment must be made within 7 days after notification by Party B.
(b) If the concealed, omitted or misrepresented goods belong to non-dangerous goods, Party A shall pay a penalty of USD 100,000/UNIT and bear all risks,ibilities, and compensation costs arising therefrom. Payment must be made within 7 days after notification by Party B.
(c) If there are concealed, omitted, orrepresented goods, upon notification by Party B, Party A must immediately pay USD 100,000/UNIT as a deposit. The relevant deposit will be used cover subsequent costs such as container damage, demurrage charges (overdue charges for demurrage involving concealment are calculated at 3 times), port charges, and related fees of customs at various locations, as well as to bear all risks, responsibilities, and compensation costs in the event of a safety accident. If there is any shortage in the, it needs to be supplemented. Payment must be made within 7 days after notification by Party B.
In addition to the above penalties and deposits, Wan H Lines also reserves the right to claim compensation from the responsible party and pursue their legal responsibility. Once again, we remind all customers to truthfully declare cargo in accordance with the law
