Recently, Huangpu Old Port Customs, under Huangpu Customs, conducted a detailed inspection of a shipment declared for export under the general trade category, with the declared product name listed as “dash cameras” and other items.

During the inspection, customs officers discovered that the contents of the container did not match the declaration. In addition to the declared goods, a large quantity of plush toy blind bags was concealed inside. These blind bags were printed with the brand logos “POP MART” and “THE MONSTERS” and displayed distinctive features of the “Labubu toy series,” totaling 1,200 units.

Based on their expertise and keen observation, the on-site officers initially determined that the goods were likely involved in intellectual property infringement. Following the required procedures, customs contacted the relevant rights holders. After careful verification, the rights holders confirmed that the goods infringed their trademark rights and copyrights registered with the General Administration of Customs and formally requested customs to detain the shipment.

The case is now under further investigation.

According to the relevant provisions of the Customs Law of the People’s Republic of China, customs authorities are responsible for protecting intellectual property rights related to inbound and outbound goods. For goods found to infringe intellectual property rights protected under the laws and administrative regulations of the People’s Republic of China, customs shall confiscate the infringing items and impose corresponding fines. If the act constitutes a crime, the responsible parties will be subject to criminal liability in accordance with the law.
